Being "whacko" is considerably different from not being competent to stand trial, and nothing which has been reported so far would even begin to qualify as meeting the standard for legal insanity required to avoid criminal responsibility for his actions.  Because he was found incompetent today does not mean that would be the finding for him even next week.
